INTRODUCTORY
THOUGHTS
The study of American constitutional
law remains a special discipline within political science. It is neither the study of law nor
politics. It is the investigation of
public or political law, i.e., that law concerned with the operation of
governments. We use this not to increase
our knowledge of law but of politics and government. By convention, we spend two semesters
studying this subject. The first
semester course, Political Science 372, is devoted to the consideration of the
powers of government; and the second semester course, Political Science 373, is
given over to an examination of the limits on those powers.
The object of this particular course
is to further and enhance your comprehension and appreciation of the rhetoric
of the United States Supreme Court as it applies to the question of the
structure of both government and politics within the American nation. Subjects covered include: judicial review, the judicial process,
separation of powers, federalism, and property rights. These subjects have been created by the
historic activity of the Court as well as by the conventions of its students.
In this course students have a special
obligation to be prepared every day to discuss the cases listed for discussion
of that particular class session. There
will be only one semester examination occurring after midterm break. In addition each student will contribute to
the mock court exercise. There will be a
final examination. The final grade will be determined by weighing each of the
following according to percentages listed:
recitation 10%, semester examination 20%, mock court 30%, and final
examination 40%.
